Terms Of Service

1. Agreement Overview

These Terms of Service (“Terms”) govern the use of home watch, property inspection, and related services (“Services”) provided by Mountain Home Watch (“we,” “our,” or “us”).
By engaging our Services, you (“Client,” “you,” or “your”) agree to these Terms in full.
If you do not agree, please do not use our Services.


2. Description of Services

Mountain Home Watch provides non-invasive, visual home watch and property monitoring services for seasonal, vacation, and secondary residences.
Services may include:

  • Scheduled inspections of the property’s interior and exterior

  • Mail and package collection

  • Maintenance coordination

  • Storm preparation and post-storm checks

  • Concierge or seasonal opening/closing services

These Services are limited to visual observations and do not constitute professional home inspections, maintenance, or emergency response.


3. Service Scheduling

  • Visit frequency and specific tasks are arranged individually with each Client.

  • Services may be postponed due to hazardous weather or road conditions but will be completed as soon as it is safe to do so.

  • The Client must provide secure access (key, lockbox, or smart lock) to the property.


4. Payment and Billing

  • Payment is due in advance of each service period, unless otherwise agreed in writing.

  • Accepted payment methods are those specified on your invoice or our website.

  • Late or unpaid balances may result in suspension of Services.

  • Service rates may change with thirty (30) days’ written notice.


5. Client Responsibilities

The Client agrees to:

  • Maintain homeowner’s insurance on the property.

  • Keep utilities active as necessary for inspections.

  • Notify Mountain Home Watch of any changes to access codes, contact information, or property status.

  • Inform us of any scheduled deliveries, service contractors, or guests.


6. Emergency Authorization

If, during an inspection, Mountain Home Watch observes a condition that appears to pose an immediate risk of property damage (e.g., active water leak, storm damage, or break-in), the Client authorizes Mountain Home Watch to take reasonable, temporary steps to mitigate damage.
Actions may include:

  • Shutting off water or electricity

  • Contacting local authorities or emergency services

  • Notifying a preferred contractor
    We will notify the Client as soon as reasonably possible after such actions are taken.


7. Disclaimer of Insurance Coverage

Mountain Home Watch is not insured or bonded.
By engaging our Services, the Client acknowledges and agrees that Mountain Home Watch does not provide insurance coverage or assume financial responsibility for loss, theft, or damage to property.
The Client agrees to maintain appropriate homeowner’s or property insurance for any potential risks.


8. Limitations of Liability

Mountain Home Watch’s Services are limited to visual observation and reporting.
We are not responsible for:

  • Hidden defects or issues not visible at the time of inspection

  • Losses or damages resulting from weather, acts of God, vandalism, theft, pests, or mechanical failure

  • Work performed or not performed by third-party contractors or service providers

In all cases, the total liability of Mountain Home Watch shall not exceed the total amount paid by the Client for Services rendered within the thirty (30) days preceding any claim.


9. Indemnification

The Client agrees to indemnify and hold harmless Mountain Home Watch, its owners, and representatives from and against any claims, damages, or expenses arising from conditions on the Client’s property, except where caused by proven gross negligence or intentional misconduct.


10. Termination

Either party may terminate Services at any time with thirty (30) days’ written notice.
Mountain Home Watch reserves the right to suspend or terminate Services immediately for non-payment, unsafe property conditions, or misuse of access privileges.
Upon termination, all property keys, codes, and information will be returned to the Client.


11. Privacy and Confidentiality

Client information, access details, and property data are kept confidential and used only for the purpose of providing Services.
We do not sell or share client information with third parties except as required by law or necessary to perform the Services.


12. Governing Law

These Terms shall be governed by and construed under the laws of the State of North Carolina, and any dispute shall be resolved in the appropriate court of Transylvania County, North Carolina.


13. Updates to Terms

We may update these Terms periodically. Updated versions will be posted on our website, and continued use of our Services constitutes acceptance of the revised Terms.
